General Terms and Conditions
The General Terms and Conditions (GTC) determine the rights and obligations of the parties in connection with the online sale of products offered by GreenyPaw (www.greenypaw.com). Any order made through this site imply that the buyer has accepted the present GTG without reservation, which he/she aknowledges that he/she has read them. Before any order, the buyer must confirm that the purchase is not directly related to his professional activity and that it is for a strictly personal use. The sellers retain the possibility of modifying at any time these Terms and Conditions, in order to respect any new regulation or in the use of their website. As such, the conditions will be those in effect at the date of the order purchased by the buyer.
The products offered are those listed on the GreenyPaw website (www.greenypaw.com) while stocks last. The sellers reserve the right to modify the product assortment at any time. Each product is presented on the website as a description of its main technical characteristics. The photographs are as faithful as possible but do not engage the sellers. The sale of products featured on the GreenyPaw website (www.greenypaw.com) is intended for all resident buyers in countries that fully allow these products to enter their territory.
The prices listed in the online shop of this website are in Euros (€) all taxes included. Greeny Paw sellers reserve the right to change their prices at any time, provided however that the price listed in the catalog on the day of the order will be the only one applicable to the buyer. The prices quoted do not include the delivery costs, charged in addition to the load of the purchaser and calculated according to the purchased products and the country of destination. Customs duties or other local taxes, import duties or state taxes may be payable in some cases. These rights and sums are not the responsibility of the sellers. They will be the responsibility of the buyer (declarations, payment to the competent authorities, etc.). The sellers invite the buyer to inquire about these aspects from the corresponding local authorities.
Prices for custom orders (animal and pet portraits) can change from year to year. When communicated (by email, on social medias, in live, etc) to a potential customer during a request for information, prices are guaranteed for a period of 2 months from the date of receipt of the information.
Orders and commissions
The artists reserve the right not to confirm an order for any reason whatsoever, in particular because of the uniqueness of the proposed artworks, a problem concerning the order received, an abnormal order or a foreseeable problem concerning the delivery to be made. The artists undertake to immediately inform the client by all the means at their disposal. The order will be processed as soon as possible upon receipt of the payment, for items in stock no later than 15 days, and for custom orders, this time will depend on the time required to complete it and the availability of the artist. When ordering, the buyer agrees to provide the information requested and commits to the veracity of the latter: full name, address, phone, email address.
Sellers only accept payments by PayPal, credit card or cheque. All credit card transactions are made via Stripe or PayPal, offering and ensuring a totally secure payment system. The page for entering your banking information is encrypted (via Secure Socket Layer technology – SSL) and they can not be intercepted and are not communicated to third parties. Payment by Paypal account or by credit card is irrevocable. When paying by card, the buyer guarantees that he/she is fully authorized to use the card and that the latter gives access to sufficient funds to cover all the costs necessary for the payment of the order. When paying by cheque, the payment is considered settled after a period of 2 weeks from te deposit of the cheque on the bank account of the sellers, so that the cheque is verified and validated by the bank.
The confirmation of an order entails the acceptance of the present terms and conditions, the recognition of having perfect knowledge of it and the renunciation to take advantage of its own conditions of purchase. All data provided and the recorded confirmation will be worth proof of the transaction.
Retention of title
The products remain the property of the sellers until the complete collection of the price (expenses included).
Under Article L121-20 of the Consumer Code, the buyer has a period of 14 working days from the delivery of his order to exercise his right of withdrawal and thus return the product to sellers for exchange or refund without penalty, except for the cost of return. The return is entirely the responsibility of the buyer (choice of the mail carrier as well as the cost of return). Products returned will only be refunded if they are in perfect condition. A cancellation of the order may be requested before the dispatch of the item(s). Custom orders can not be returned or exchanged. If the buyer wishes to cancel a custom order in progress, no refund will be made.
Deliveries are made to the address indicated on the order form which can only be in the agreed geographical area. Deliveries are made by La Poste. All orders are sent by tracked mail and orders of original artwork are delivered by registered mail. The paintings on canvas are sent by Colissimo (registered parcel). Delivery times are only indicative; if they exceed thirty days from the order, the contract of sale may be terminated and the buyer refunded. Delivery times do not take into account the time of creation of the custom orders. The sellers will be able to provide by email to the buyer the tracking number of his parcel. Shipping risks are the responsibility of the buyer from the moment the items are sent. The buyer is obliged to check in the presence of the employee of La Poste or the delivery person, the condition of the packaging of the goods and its contents upon delivery. Any protest must be made to the mail carrier (La Poste for any order made in France, the postal carrier of the country of the destination in case of order made abroad) within 3 days of delivery in case of damage during transport, and within 15 days in case of delay or loss.
All claims, requests for exchange or refund must be made by contacting GreenyPaw’s artists via the email address: greenypaw [a] gmail.com, within 30 days after delivery.
Sellers, in the process of distance selling, are held only by an obligation of means. Their liability can not be held liable for damage resulting from the use of the Internet such as loss of data, intrusion, virus, service interruption, or other unintended problems.
All elements of the GreenyPaw website (www.greenypaw.com) are and remain the intellectual and exclusive property of the artists. Nobody is allowed to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the website whether in the form of photo, logo, visual or text. No assignment of intellectual property rights is carried out through these GTC. Any total or partial reproduction, modification or use of these goods for any reason whatsoever is strictly prohibited.
The administrators of the Greeny Paw website undertake to preserve the privacy of the information provided by the buyer, which they would have to transmit for the use of certain services. All information concerning the buyer is subject to the provisions of the Data Protection Act No. 78-17 of 6 January 1978. As such, the user has a right to access, modify and delete information. He may request it at any time by sending an email to the following address: greenypaw [a] gmail.com. By adhering to these Terms and Conditions, the buyer agrees that the administrators of this site collect and use this data for the realization of the contract. By entering his email address on this site, he also agrees to receive emails containing information and promotional offers related to the professional activity of the website’s administrators. The user can unsubscribe at any time by clicking on the link at the end of the emails received or contact the artists by registered letter with acknowledgment of receipt.
The performance of the sellers’ obligations at the end of the present GTC is suspended in the event of the occurrence of a fortuitous event or force majeure that would prevent its execution. The seller will notify the customer of the occurrence of such an event as soon as possible.
Nullity et modification of the contract
If one of the stipulations of the present contract is canceled, this nullity does not entail the nullity of the other stipulations, which remain in force between the parties. Any contractual modification is valid only after a written agreement signed by the parties.
All clauses in these GTC, as well as all the purchase and sale transactions referred to therein, will be subject to French law.
